Criminal Sentencings; July 2011

  • propation violation; 23 year old East Tawas man sentenced to 4 months in jail, less credit for 32 days served on one file – 32 days served on two others.
  • attemped delivery of a controlled substance; 25 year old Oscoda man sentenced to 9 months in jail, less credit for 108 days served, to run concurrent with other sentences – ordered to pay $1,663.00 in fines, costs and fees, 1 year suspended license – eligible for restriced permit after 2 months.
  • probation violation/failure to report, failure to change address, non payment of assessments; 26 year old Oscoda woman sentenced to serve concurrent terms of 90 days on a tether, less credit for 15 days served.
  • possession of controlled substanse less than 25 grams/cocaine; 33 year old East Tawas man sentenced to 145 days served and assessments totolaing $1,580.00, 6 months suspended/restricted license.
  • attempted failure to comply with sex offender registration; 35 year old Tawas City man sentenced to 3 months in jail, less credit for 49 days served, assessed $1,598.00 in fines.
  • embezzlement by an agent of at least $1,000.00 but less than $20,000.00; 37 year old Newport Florida man sentenced to 9 months in jail less 26 days served, as part of a 5 year probation term, assessed $1,598.00 in fines, cost, fees and was ordered to reimburse Iosco County $922.00 in extradition costs. In a separate hearing he was ordered to pay restitution of $38,747.00 to the Oscoda Yacht Club and its insurance company.
  • violating probation/use of alcohol; 21 year old Oscoda woman was sentenced to 60 days in jail less credit for 47 days served, revoked status under the  Holmes Youthful Trainee Act (HYTA), unsealing the file.
  • attemped possession of morphine; 33 year old Oscoda woman sentenced to 6 months in jail, less credit for 59 days served, 6 months suspended license with ability to apply for restricted license after 1 month, assessed $1,598.00.
  • delivery/manufacture of marijuana – maintaining a drug housr; 61 year old Whittemore man was sentenced to concurrent 1 year jail terms, less credit for 1 day served, as part of a 2 year probation, $1,631.00 fines, costs and fees, 1 year suspended license – eligible for restricted license after 60 days.
  • criminal sexual assault; 22 year old Vernon man sentenced to 23 months to 12 years in prison, $1,343.00 in assessments, required to register as a convicted sex offender.
  • misdemeanor aggravated assault; 36 year old Holly woman sentenced to 60 days in jail, less credit for 1 day served, as part of a 2 year probation term, $2,413.00 fines, fees, and costs, $125.00 restitution.
  • attempted felonious assault with a dangerous weapon; 53 Oscoda man was sentenced to 5 years probation, mental health treatment, $2,198.00 in assessments.

  • attempted larceny in a building; 26 year old Omer man was sentenced to 30 days in jail, less credit for 15 days served, as part of a two-year term of probation, $615.00 restitution, $1,948.00 fines, costs & fees.
  • attempting to kill/torture animals, 3rd offense habitual notice; 26 year old Tawas City man sentenced to 1 year in jail, consecutive to sentences for three crimes for which he was on parole until June 9, 2012, assessed $1,598.00 in fines, costs and fees, probhibited from owning an animal for 5 years.
  • attempted 3rd degree criminal sexual conduct; 22 year old Prescott man was  sentenced to 2 to 5 years in jail, consecutive to a 2009 conviction, $467.00 restitution, $1,598.00 court assessments, register as a convicted sex offender for life.
  • probation violation/failure to report; 27 year old Hale man was sentenced to concurrent terms of 4 months in jail, less credit for 49 days served with an  unsuccessful discharge from probation upon completion.
  • delivery/manufacture of marijuana-maintaining drug house; 49 year old East Tawas woman sentenced to concurrent 7 month jail terms on each of two counts, 2 years probation, $1,734.00 fines, costs, fees, and restitution, 60 days suspended license,  additional  305 days restricted license:  in connection with the above matter she was sentenced to 3 months in jail, less credit for 2 days served, as part of 2 years probation, $1,864.00 assessments, 6 month suspended/restricted license.
  • larceny in a building/uttering-and-publishing/forgery; 26 year old Oscoda man sentenced to 3 concurrent prison terms, minimum 18 months on each count, maximum 4 years for larceny, 14 years on the other 2 convictions, less credit for 3 days served, $2,377.00 fines, costs, fees, including $442.00 restitution.
  • conspiracy to utter-and-publish/ uttering-and-publishing; 25 year old former Tawas City woman sentenced to 2 concurrent prison terms of  14 months minimum and 28 years maximum in prison.
  • probation violation/ consumption of alcohol; 30 year old East Tawas man sentenced to 31 days served,  continued probation.
  • criminal sexual conduct/assault with intent to commit penetration; 22 year old Beaverton man sentenced to 55 months minimum and 10 years maximum, less credit for 185 days served, $2,143.00 fines, costs, fees, register as sex offender.
  • 2 counts of attempted 3rd degree criminal sexual conduct; 42 year old Oscoda man sentenced to 2 years minimum and 5 years maximum on each count, 1 year for bail jumping. All terms concurrent and credited be 439 days served, $1,573.00 assessments, register as convicted sex offender.
  • probation violation/2 counts attemped delivery/manufacture of controlled substance; 35 year old Oscoda woman sentenced to concurrent 30 day jail terms, less credit for 33 days served, 2 years additional probation.
  • unlawful use of a motor vehicle; 22 year old Oscoda man sentenced to 11 months in jail, less credit for 74 days served, as part of a 2 year probation, $2,560.00 fines, costs, fees, including $722.00 restitution for extradition costs.
  • probation violation/commiting new crime, domestic assault; 27 year old Gaylord man, formerly of National City was sentenced to 30 days in jail, less credit for 19 days served, continued probation.
  • 3rd degree criminal sexual conduct; 27 year East Tawas man sentenced to concurrent terms of 10 to 15 years in prison on each count, $2,138.00 fines, fees and costs, register as a sex offender.
  • attemped 2nd-degree criminal sexual conduct; 49 year old Turner man sentenced to 1 year in jail as part of 5 year probation term, $1,943.00 in fines, fees and costs, register as a sex offender.
