Currently, the Justice Department, after pressure from the Senate Judiciary Committee, is conducting a post-conviction review of all forensic testimony by the technicians from the FBI Laboratories who performed microscopic examination of human hair. It turns out that 26 of the 28 examiners who were working for the FBI “overstated forensic matches in the ways that favored Prosecutors in more than 95% of the 268 trials reviewed.” In fact, 32 of those defendants were sentenced to death, and in 14 of those cases, the prisoners had naturally died or been executed. Incredibly, 4 were exonerated. In fact, the exoneration rate based upon the sample test was about 12%.

In another jurisdiction where the FBI technicians testified, 7 Defendants were convicted with flawed FBI evidence and of those 7, 3 have been exonerated, 2 more are waiting exoneration, and of those who were exonerated, each had served between 20 and 30 years in prison.
